Die von Apple Entwicklern eingef\u00fchrte 'Option' hat die Firma jetzt 113 Millionen US-Dollar zus\u00e4tzlich in einem Prozess gekostet.<\/p>\n<p><!--more--><\/p>\n<h2>Das iPhone #slowdowngate<\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/vg07.met.vgwort.de\/na\/c73aaef912e74710a57a2a3256a8b8a0\" alt=\"\" width=\"1\" height=\"1\" \/>Erinnert sich noch war an das #slowdowngate? Ende 2017 kam heraus, dass Apple die Geschwindigkeit bei iPhones k\u00fcnstlich gedrosselt hat, wenn das Akku etwas gealtert war. Es gab ja schon immer Vermutungen, dass Apple alte iPhones irgendwie k\u00fcnstlich ausgebremst w\u00fcrden, um den Verkauf von Neuger\u00e4ten anzukurbeln. Ich hatte im Sommer 2014 einen entsprechenden Artikel im Blog (siehe <a href=\"https:\/\/borncity.com\/blog\/2014\/07\/31\/big-data-analyse-werden-alte-iphone-modelle-gebremst-um-verkufe-neuer-iphones-anzukurbeln\/\">Big-Data-Analyse: Werden alte iPhone-Modelle \"gebremst\" um Verk\u00e4ufe neuer iPhones anzukurbeln?<\/a>).<\/p>\n<p>Ich hatte die Verlangsamung von iOS-Ger\u00e4ten auf iOS-Updates geschoben, die immer fetter wurden und mehr CPU-Leistung sowie Grafikpower und RAM erfordern. Aber Nutzer haben festgestellt, dass iPhones, die keine iOS-Updates bekommen haben, mit der Zeit ebenfalls deutlich langsamer wurden. Nachgewiesen hat dies ein Benutzer, der auf reddit.com mit dem namens TeckFire. Der hat mit einem Benchmarkprogramm nachgemessen und die Ergebnisse auf <a href=\"https:\/\/web.archive.org\/web\/20210305200002\/https:\/\/www.reddit.com\/r\/iphone\/comments\/7inu45\/psa_iphone_slow_try_replacing_your_battery\/\" target=\"_blank\" rel=\"noopener noreferrer\">reddit.com publiziert<\/a>. Er konnte nachweisen, dass \u00e4ltere Ger\u00e4te durch iOS gedrosselt werden.<\/p>\n<h3>Der technische Hintergrund<\/h3>\n<p>iOS enth\u00e4lt Code, um die Prozessorleistung der CPU zu drosseln, wenn die Akkuleistung durch Alterung, K\u00e4lte oder Entladung sinkt. Eingef\u00fchrt wurde dies mit iOS 10.2.1, um das unbeabsichtigte Abschalten (u.a. bei K\u00e4lte) zu verhindern. Von Apple gab es gegen\u00fcber <a href=\"https:\/\/web.archive.org\/web\/20171230195726\/http:\/\/news.softpedia.com:80\/news\/apple-confirms-it-slows-down-old-iphone-devices-to-prevent-unexpected-shut-downs-519070.shtml\" target=\"_blank\" rel=\"noopener noreferrer\">US-Medien<\/a> eine Stellungnahme, die dies erkl\u00e4rt.<\/p>\n<p>Apple hatte nach Bekanntwerden des Sachverhalts bei iOS nachgebessert und das Feature abschaltbar gemacht. Als iOS 11.2.5 heraus kam, war diese Drosselung abschaltbar (siehe <a href=\"https:\/\/borncity.com\/blog\/2018\/01\/23\/apple-verffentlicht-ios-11-2-5\/\">Apple ver\u00f6ffentlicht iOS 11.2.5<\/a>).<\/p>\n<h3>Klagewelle gegen Apple<\/h3>\n<p>Der Umstand, dass Apple diese Software-Drosselung nicht kommunizierte (nur die <a href=\"https:\/\/support.apple.com\/kb\/DL1893?locale=de_DE\" target=\"_blank\" rel=\"noopener noreferrer\">Release-Notes<\/a> von iOS 10.2.1 erw\u00e4hnen das recht nebul\u00f6s) und nicht einstellbar machte, f\u00fchrte dazu, dass Nutzer sich nicht nur ziemlich angepisst f\u00fchlen. Es wurde auch eine Klagewelle angesto\u00dfen. Zum 18. November 2020 hat der kalifornische Generalstaatsanwalt Xavier Becerra bez\u00fcglich der Sache einen Vergleich der Kl\u00e4ger in 33 US-Staaten mit Apple <a href=\"https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-becerra-announces-113-million-multistate-settlement-against\" target=\"_blank\" rel=\"noopener noreferrer\">bekannt gegeben<\/a>. Apple wird 113 Millionen US-Dollar an die Kl\u00e4ger als Entsch\u00e4digung f\u00fcr die gedrosselten Ger\u00e4te zahlen. Ich habe den Text der Mitteilung mal nachfolgend herausgezogen, da diese irgendwann gel\u00f6scht wird.<\/p>\n<blockquote><p>California Attorney General Xavier Becerra, alongside 33 other states and the district attorneys for the counties of Los Angeles, Alameda, Santa Clara, San Diego and Santa Cruz, today announced a $113 million settlement against Apple. The settlement resolves allegations that the company made misrepresentations about iPhone batteries and software updates that throttled processing performance in order to manage insufficient battery power in its phones. \"Throttling\" refers to the purposeful reduction in system performance to prevent the automatic shutdown of phones with aging batteries. California will receive $24.6 million of the total settlement, which also includes injunctive terms that will provide transparency to consumers and deter future misrepresentations regarding Apple's battery capability.<\/p>\n<p>\"Apple withheld information about their batteries that slowed down iPhone performance, all while passing it off as an update,\" <b>said Attorney General Becerra<\/b>. \"This type of behavior hurts the pockets of consumers and limits their ability to make informed purchases. Today's settlement ensures consumers will have access to the information they need to make a well-informed decision when purchasing and using Apple products.\"<\/p>\n<p>\"My Office works very hard on behalf of consumer rights throughout the county and the state. We are proud to act in conjunction with the California Attorney General, district attorney offices throughout California, and attorneys general around the country to ensure that Apple is held accountable for not telling customers that their iPhones might be slowed down as a result of the upgrade,\" <b>said Alameda County District Attorney Nancy O'Malley<\/b>. \"When a company, large or small, acts in a manner that may mislead consumers, we will take action.\"<\/p>\n<p>\"We are pleased that Apple Inc. has agreed to comply with state consumer laws,\" <b>said Los Angeles County District Attorney Jackie Lacey<\/b>. \"With this settlement, the technology company has pledged to provide clear and conspicuous communication to consumers about lithium-ion batteries, unexpected shutdowns and performance management. We as prosecutors are here to protect consumers and ensure that all companies, large and small, provide transparency so that their customers are fully informed when they spend money on products.\"<\/p>\n<p>\"We are proud to be one of the initiating prosecutorial agencies in this consumer protection case,\" <b>said Santa Cruz District Attorney Jeffrey Rosell<\/b>. \"Our office works diligently to protect the people of Santa Cruz County, even against the largest corporations in the world. We are committed to protecting the rights of all California consumers, especially those in Santa Cruz County, and work collaboratively with other agencies to achieve this goal.\"<\/p>\n<p>California's complaint alleges that Apple equipped their iPhone 6 and 7 generation phones with batteries that were particularly susceptible to performance loss, which led to unexpected power-offs when those batteries could not provide sufficient voltage to support phone processing performance. According to the complaint, Apple tried to manage the problem through software updates that avoided unexpected power-offs by throttling the phones' processing performance. Apple also allegedly misrepresented the effects of the software updates by claiming they would improve power management rather than admitting that the updates would actually reduce performance.<\/p>\n<p>In addition to paying $113 million, Apple has agreed to injunctive terms, which include:<\/p>\n<ul>\n<li>Maintaining a prominent and accessible webpage on their website that provides clear and easily visible information to consumers about how the company manages battery performance issues, such as by throttling iPhone processing performance;<\/li>\n<li>Providing a clear and easily visible notice to all affected consumers when an iOS update materially affects iPhone processing performance;<\/li>\n<li>Providing information in the iPhone settings menu about the consumer's battery performance and maximum capacity as well as a notice of when a battery has experienced performance degradation of a significance that the consumer should service the battery; and<\/li>\n<li>Training its consumer-facing staff regarding compliance with this injunction and the information that this injunction requires Apple to provide to consumers.<\/li>\n<\/ul>\n<p>Apple has also settled private class action litigation that resulted in up to $500 million in restitution for consumers who were affected by the misconduct alleged in California's complaint.<\/p>\n<p>A copy of the complaint and California's stipulated judgment are available <a href=\"https:\/\/oag.ca.gov\/sites\/default\/files\/Apple%20complaint%20-%20stamped%20copy.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a> and <a href=\"https:\/\/oag.ca.gov\/sites\/default\/files\/Apple%20Judgment_0.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a>.<\/p><\/blockquote>\n<p>Bei heise weist man <a href=\"https:\/\/www.heise.de\/news\/Sammelklage-wegen-iPhone-Leistungsdrossel-Apple-will-mehr-zahlen-4965062.html\" target=\"_blank\" rel=\"noopener noreferrer\">hier<\/a> darauf hin, dass Apple im M\u00e4rz 2020 bereits im Rahmen von Verbraucherschutzklagen 500 Millionen US-Dollar Entsch\u00e4digung gezahlt habe.
